6. Virtual Items & In-App Purchases
The Services may include virtual items, virtual currency, or in-app purchases (“Virtual Items”).

Purchases are final and non-refundable, except where required by law or platform policies

APPatheia may modify or discontinue Virtual Items at any time
All purchases are processed through Apple App Store or Google Play and are subject to their terms.
7. Advertising
The Services may display advertisements. APPatheia is not responsible for the content of third-party advertisements or linked websites.
8. User Content
You may be permitted to submit content (e.g., usernames, avatars, gameplay interactions).
You grant APPatheia a worldwide, royalty-free, sublicensable license to use, display, and distribute such content in connection with operating the Services.
You represent that you have all necessary rights to any content you submit.
9. Intellectual Property
All content, software, graphics, audio, and trademarks associated with the Services are owned by or licensed to APPatheia and are protected by intellectual property laws.
You may not copy, distribute, or exploit any part of the Services without prior written permission.
10. Termination
APPatheia may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms.
Upon termination, your license to use the Services immediately ends.
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
APPatheia does not guarantee uninterrupted or error-free operation.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPATHEIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
IN NO EVENT SHALL APPATHEIA’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO APPATHEIA IN THE SIX (6) MONTHS PRIOR TO THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify and hold harmless APPatheia and its members, officers, employees, and partners from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
14. Governing Law & Venue
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.
Any legal action shall be brought exclusively in the state or federal courts located in California, unless otherwise required by law.
15. Changes to These Terms
APPatheia may modify these Terms at any time. Updated Terms will be effective upon posting. Continued use of the Services constitutes acceptance of the revised Terms.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
